Is it illegal to sell replica or designer inspired handbags?
I was in an indoor flea market in San Antonio today and there were at least 5 shops selling these out in the open with police walking all over the place. I thought it was illegal. Is there some sort of loop hole? These peoples’ shops have been there for years selling only handbags,and sunglasses, etc. All knockoffs!
Obviously, there is some loophole. What is it?

It’s probably only illegal if they tell someone that it is 100 the item and sell it at that price… rip off…
yeah, its really illegal. When the police come by, they all run for it. for their lifes. the trick is not getting caught, this is the on;y way they can make a lifestyle. no loophole, just sneekyness.
Yeah its illegal but take chinatown in NYC for example. HUNDREDS of shops selling that stuff and rarely do they shut them down..the cops know about them too. I’m thinking they just don’t care..its crazy.
Yes it is illegal. It’s called trademark infringement. Trademarks are a type of intellectual property which are protected by state law, federal law and international treaties. Copyrights are another example of intellectual property.

In cases of bad faith the monetary damages are trebled.
You don’t see the small time infringers getting in trouble because companies like to focus their money and effort on those that are selling or producing the goods at a massive level. That doesn’t mean it doesn’t happen though.
Oh, and playing stupid saying “I didn’t know it was fake and/or illegal” or “everyone makes fakes” doesn’t make a difference. I laugh each time a small time store owner makes that claim when they finally get caught. Breaking the law is breaking the law.
